Davis-Bacon Wages

WHA's Labor Compliance effort ensures that construction laborers are paid prevailing wages​ as outlined in the Davis-Bacon Wage Rate Act, and associated​ HUD​ regulations. In order to assure compliance with the law, WHA undertakes a variety of actions including:
  • Construction site visits
  • Construction worker interviews
  • Review certified payroll records for accuracy
  • Resolve payment discrepancies
The Davis-Bacon Act

The Davis-Bacon Act applies to all construction, alteration, repair or renovation projects using federal funds in excess of $2,000. Each solicitation issued by DHA contains the Wage Determination upon which contractors should base pricing. The contract will incorporate the Wage Determination that the contractor must use. For prime contracts in excess of $100,000, contractors and subcontractors must also, under the provisions of the Contract Work Hours and Safety Standards Act, as amended, pay laborers and mechanics, including guards and watchmen, at least one and one-half times their regular rate of pay for all hours worked over 40 in a workweek. The overtime provisions of the Fair Labor Standards Act may also apply to DBA-covered contracts.
